Terms of Service

Effective Date: August 23, 2026. These Terms of Service ("Terms") govern the commercial relationship, consultation engagements, and use of the web platform operated by Launch Overseas Limited ("we", "us", or "our"), registered in the Hong Kong Special Administrative Region.

01. Preliminary Inquiries & Engagement Scope

Non-Binding Exploratory Communications

Information presented on this website, introductory feasibility summaries, and preliminary electronic communications via email or official web forms are provided for informational and exploratory evaluation purposes only. No formal agency, fiduciary, distributor, or legal representation relationship is established until both parties execute a formal written agreement and Statement of Work (SOW).

02. Commercial Advisory & Regulatory Disclaimers

Statutory Filings & Third-Party Actions

While Launch Overseas Limited prepares and coordinates regulatory submissions (including US FDA notifications, EU CPNP toxicology files, and trademark filings), final authorization timelines and official certifications remain within the sole statutory discretion of relevant governmental authorities. We do not warrant specific commercial sell-through numbers or retail door acceptance by independent third-party retail buyers.

03. Intellectual Property & Confidentiality

Client Asset Ownership

All client trademarks, product formulations, packaging assets, patent rights, and proprietary commercial strategies remain the exclusive intellectual property of the respective client. Launch Overseas Limited does not acquire ownership of client IP unless explicitly licensed under a signed commercial licensing contract.

04. Limitation of Commercial Liability

Liability Boundaries

To the maximum extent permitted by Hong Kong SAR law, Launch Overseas Limited shall not be liable for any indirect, incidental, consequential, or punitive damages arising from freight delays, overseas customs holds, third-party logistics disruptions, or statutory policy changes in target export jurisdictions.

05. Governing Law & Dispute Resolution

HKIAC Administered Arbitration

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute, controversy, or claim arising out of or relating to these Terms shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong.
